It argues, when the necessary revisions are incorporated, USCIS will return the proposed rule to DHS for final clearance. Once cleared the time line for DHS submission to OMB is 3 months. Irrespective of the pending motion, the H-4 EAD remains available. So continue filing until a final regulation takes effect. Quote
