if you have rental agreement with him, then tell him you will sue him in small claim courts. If not you cant do anything. Tell him you will complaint to city about illegal rental business or something. based on length on stay normal wear and tear is not eligible for holding deposit.

This is a civil matter.  How long have you been staying in this house? Usually, landlords or real estate management companies charge a cleaning fees, even if you hired a professional cleaner (that's why I dont recommend any professional cleaner when you are vacating). 

If you have pics from the move-in date and the move-out date, just file a case in small claims court.

Even when your home owner wants to withhold $1000, he has to send you a bill for that, saying that they don't owe you any refund.

In Cali, I have seen apartment complexes are taking $500 for cleaning and other crAp.
