H1 Transfer after I-140 Approval

H1b transfer after I-140 approval from A to B.     B wants to change SOC Job Code with better pay. Pros and Cons and any experiences please. Thanks in advance vayyas.

B can sponsor

SOC is specific to that petition, no issues

may get rfe prove your exp in new soc and also speciality occupation

they will say you are not skilled in new soc so not eligible for H1b which is skilled immigrant visa

Wait for 180 days after I140 approval and you can jump however you like.

Already 180 days over bhayya. But kinda worries about RFE and I  really dont want to go for perm again immediately

So even after changing SOC Code you can still use your approved i-140 and no need to apply for new 140 immediately bhayya?

You have to start from Perm even if you have same job duties and soc. The I-140 rule is just to port you PD but you still have to follow the process like anyone else.

So whats the point of having approved i140 bhayya  if you have to go all over again?

An approved 140 (esp. one past 180 days) helps you get H1 extensions beyond the six year limit.. even if the new company you joined hasn't processed a new 140 yet. Also you get to keep your old priority date which is basically your spot in the lengthy GC queue.

I140 is just to extend beyond 6 years.... PERM and I140 has to be done all over again once you change your job .. No escape ...

Thanks bhayya. I cannot be in the same title from start to finish of GC with same pay and same title anyway. So porting is done at the time of extension?

No extension is just limited to your H1 status. The priority date porting happens when the new company processes the GC petition again.. at the new PERM stage.

140 approved is no use these days other than just to get ONLY ELIGIBILITY for applying H-1 extension. No default H-1 extension approvals based on with approved i140.

Every amendament or extension is new H-1B.

So even if we change SOC code, get promoted with new job title with better salary can manage to get extensions and dont worry till the  priority dates become current?
