(Steven Senne/Associated Press) NEWTON, MA — The state Attorney General said federal authorities launched a "politically motivated attack" with the indictment of a Newton judge accused of helping a man escape federal immigration officers. Massachusetts U.S. Attorney Andrew Lelling announced Thursday a federal grand jury had indicted Newton District Judge Shelley Joseph and a court officer on three counts of obstruction of justice. The pair were accused of allowing a man wanted by Immigration and Customs Enforcement (ICE) to escape court through a back door. Quote

Every discretion can be seen as politically motivated. Whenever prosecutors don't want to file charges, they call it "prosecutorial discretion" (Think of Comey, FBI, and Obama Justice department in handling Clinton email hack). Whenever a judge does not want to impose a stiff sentence, it is called "judicial discretion": for example, an Iraqi vet was busted for kiddie p0rn in Seattle, and he was given 2 years probation, I believe. If the defendant was not a vet, he would be serving for life. Whenever an immigration officer or border agent make a decision on whether to deny an application, whether to deport, they are using discretion. That's the nature of law. Without discretion, you will end up with "legal formalism". Ordinary folks are sold a bunch of fake goods that law is a set of rules, which are applied axiomatically. Discretion is applied at every level. You call it politically motivated, when you don't like the outcome (in this case, the state judge opening a side door--thereby being an accessory). Discretion is good when both sides of the political spectrum won't make a fuss. That's why District attorneys are tough on some petty crimes, thereby ruining lives of many minorities. Quote

That's what prosecutors do when they want to go easy on their buddies or a political group. Quote
