05/22/2019: USCIS Spring 2019 Rule-Making Plans

• USCIS is planning several rule-making agenda this year, including the following:
  • Strengthening H-1B program: Intends to (1) revise the definition of specialty occupation to increase focus on the best and the brightest nationals via the H-1B program; (2) revise definition of employment and employer-employee relationship to better protect U.S. workers and wages; and (3) propose additional requirements designed to ensure employers pay appropriate wages to H-1B workers.
  • H-1B cap registration fee requirement for the employers
  • Immigration sevices filing fees change (increase)
  • Accelerate electronic processing of petitions and applications
  • Three rules on EB-5 investment immigration progras:
    • EB-5 program realignment
    • EB-5 regional center requirements
    • EB-5 program modernization (increasing investment amount)
  • Removal International Entrepreneur Parole Program
  • H-4 EAD removal 
  • Modernization of H-2B program recruitment requirement
  • Updating I-485 procedures for more efficient processing and immigrant visa usage

Definitions about who is skilled immigrant to get H-1 or what is employer-employee relation especially to employees working in consulting were not written properly or interpreted from 1990 H-1 rules. So, current admin is redefining to interpret properly.

Don’t expect such. These H-1 changes are mostly approved and aiming to implement before Oct-2019 to apply FY2021 H-1 quota

My comment was about h4 EAD removal. Won't happen anytime soon. They seem to be clueless about how to proceed
