Checking whether I can stay.

Hello Freinds.

My H1b Extension status has been updated as NOID( Notice of Intent to Deny) and my I-94 is also expired on 08/15/19. NOID is because of Stratford University For Profit organization. H4 petition has been launched on the same date of I-94 expiry 8/15/19 overnight delivery. H4 Petition has reached to USCIS on 08/16/19. Is this considered as a valid petition or not. Can i still stay in USA in this case? Please share your thoughts as my family is here and need my support to them.

Naaku unna koncham knowledge prakaram .. the petition has to reach USCIS on or before i-94 expiry.

It is always better to consult an attorney as this is a really close call.

I agree with him, consult a lawyer, and also not to worry about anything. From your above statement I understand that your wife is also on H1B so go out of the country and come back on H4. Then apply for EAD and wait for next year to file H1B in regular quota. If your H4 petition has already been filed and that too within  i-94 expiration date you can not leave the country. 

Anyway, you better consult with a lawyer. Sorry for the bad tidings.

according to bla bla u are out of status officially, but don't be panic h4 ki changed so they will ask you to get visa stamp in India..... so son't leave the country untill matter settles down .. all the very best .... your not the person in same boat there are many like you cheers

I might be wrong , But since your i94 is expired , I don't think you can apply for h4 status change from inside US.

As people told , consult attorney . that is the best option.
