08/17/2019: U.S. and Canada Signed on 08/16/2019 an Agreement to "Expand Preclearance" Between Two Countries

  • This new agreement not only expand preclearance from the "Air" transport to "Land, Rail, Marine, and Air (LRMA)" transport, but also expansion of preclearance sites from the current Canadian airports in Calgary, Edmonton, Halifax, Montreal, Ottawa, Toronto, Vancouver, Winnipeg, and multi locations in British Columbia to All Modes of Transportation and Exploration of Co-Locations at Small and Remote Ports of Entry." The new agreement will also include additional tools and authorities to help enforce immigration, customs, and agriculture laws, facilitate lawful travel. This agreement was signed on 03/16/2015 between the two governments at the Executive Branch" only and not enforceable since these international agreements needed passage by the Legislative Branch of each country. In December 2016, U.S. Congress passed this Agreement into law and the legislature in Canada passed its legislation in December 2017, but did not publish implementing regulations in Canada until June 2019. Yesterday, 08/16/2019, the U.S. Government and the Canadian Government exchanged "Diplomatic Note" allowing implementation of "Preclearance Expansion" policies in both countries.
  • Obviously, more details will soon be released by the DHS sooner or later. Please stay tuned.
