08/27/2019: Watch for "Potential" Action by the USCIS on H-4 EAD Removal Proposed Rule in September

• This proposed rule was submitted to the OMB in February this year and has been delayed based on the federal court's decision to give more time for the USCIS to make decision on removal of H-4 EAD by its own rule-making instead by the federal court decision. The court has repeadedly delays decision based on USCIS motion, including its plan to repeal the H-4EAD by regulation. We are not certain whether the court will further delay its decision in the pending litigation to give the USCIS more time to complete rule-making process after the upcoming scheduled hearning on 09/27/2019. There is no clear indication at this time as to what will happen with the USCIS as well as the federal court after next month. We post this message to just alert the H-4 EAD community to watch development in Septemter 2019!
