HeCHh-1 related problem

asking for friend . 
 

He is here in US on H4 (His hech-1 entry was denied in the past) . He found a job through a employer ( Mesthri—-> WiTCH —-> American Client) and he applied for H1B under cap exemption. Mesthri was confident and pushed him to join the job . My friend joined the job and he gave ITIN In the place if S-S-N for verification.

Now , his hech-1 is denied and simultaneously he also filed H4 E-A-D. Mesthri asking to continue with the work , mesthri payroll kuda h4-e-a-d vachaka run chests antunnadu.

Ma friend is concerned about the consequences.

WTF, how can he work without H1B approval? You said he entered US with H4 status. He is still on H4. Applying COS doesn’t mean it is approved.

1 week la approve aiddi ani join avvamantey ayyadu bro .  Asalu , itin tho background check ela. Clear aindo na doubt .

Once it was denied, the case was closed. 

 

He is not exempted from the cap anymore unless I got this wrong. 

 

The only petitions that are cap exempt are 1) Valid I-140, 2) Universities H-1Bs, 3) Renewals/Extensions
