Employer tho overtime pay issue $3000

I worked overtime and need to get paid around $3000

I submitted timesheets for overtime I worked and have client timesheets for the same

employer said we can keep it with him (by not paying) so that he can use that money to run an extra paycheck if my job gets in trouble due to covid etc 

I asked for that money and he is dragging on saying first he does not remember and he need to double check the amount etc 

I get paid more than lca salary per annum 

can employer escape by not paying me ?

Legal answer is YES for both those questions. 

 

Reason is you are a salaried employee and not hourly.

tell him.. if he is ok risking u/ur position for mere 3000$..

as he can earn that in 1 or 2 months on you

send him mails or messages (if u have any).. also time sheets screenshots and balance details after calculating balance - salary received as per lca

i do this every 3 months to remind employer how much he owe me
