As you are aware, on October 8, 2020, the DOL increased the prevailing wages unreasonable and arbitrarily making it impossible for companies to file LCA or to hire H-1B workers. 

As an alternative to the increased DOL’s OES wages, our office submitted LCA’s using the Alternate Wage Sources, which got certified.  The wages obtained from other surveys are 60%+ less compared to the OES wages.  For example, the Level 4 wages for a software Developer for Middlesex County, NJ as per the alternate wage source, is $89,652.00, whereas Level 4 as per DOL’s OES survey is $217,526.00.  It’s great news for all the companies that were hit hard with the DOLs increased wages.

Will USCIS accept the LCA certified with Alternate Wage Sources?
Yes.  Once the LCAs are certified by DOL, USCIS cannot challenge the validity of the LCA

Why should DOL accept the Alternate Wage Report and not OES?
The regulation requires DOL to accept any independent, authoritative sources used by the employer in determining the prevailing wages [20 CFR § 655.731(A)(2)]

How to choose the right Alternate Wage Report?
The survey must have been published within 24 months of the date of submission of the prevailing wage request; be the most current edition of the survey; and be based on data collected within 24 months of the survey's publication.  Also, the wage data submitted by the employer must reflect the area of intended employment.

How much does it cost to obtain an Alternate Wage Report?
It can cost anywhere between $650-$1000 depending on the survey.  Our office is purchasing bulk licenses so that we can keep the cost low for our clients.

What are the major private surveys?
The three major alternate wage surveys are from Mercer, Watson-Tower, and Radford.

Good info! Just to confirm, LCA filing is free with OES Survey, where as with alternate sources consultant may have to pay up to $1000, correct?

That is what it is on average... 

 

The abuse is done by prime vendors , not employer not client 

 

They are taking more than 10$ cut..hence salaries are down

In my case around 80$ cut

I know but 89k for level 4 is very low in NJ. Low cost of living state lo unta Nenu and that is level 2 wage for us even using old DOL wages. The abuse is rampant

My company did it for me in my previous extension way back in 2017 . Pedda issues em raledu .. naa role level 4 and wage level was 5k more than what i was making at that time
