H4 , H4 EAD Pending - India Travel

Hello DB Members , Need some imp help and suggestion

My wifes dad is sick due to covid , she wants to travel to India. Her current H4 stamp in passport is valid till April 2021.

In october , I applied H1 Extension , H4 + H4 EAD , My petition got approved and her H4 and H4 EAD are pending.

 

Due to family situation if she needs to go India and come back before April 2021 , will there be any problem in her H4 and H4 EAD processing as she will be Out Of country.

Mean while when she is Out Of country finger prints ki pilisthey em cheyyali ?

 

Please Advise , Couldnt get hold of attorney due to weekend

Fingerprinting ki piliste, u can call them and re-schedule, but processing delay untadi.

u need to be ready for that.

She can come back without any problem before April 2021.

But there is probability her h4 approval might approve with out new i94. In that case she needs to again go out of country for stamping before start of April 2021.

yeah I 94 change aitadi, u might need to check with ur lawyer..

See if she is eligible from Dropbox , if so she can get her H4 stamped .no need to worry about the current H4 Application.. 

once she comes back to US , ask your lawyer to withdraw her old h4 petition but keep the EAD one and provide the visa copy to uscis.. then she should be good.

The only catch here is , As a primary applicant they may ask if you have H1 Stamping or not.. I have heard one case where they stated that petitioner needs to be there as well as the H4 applicant .
