My friend's brother 485 had RFE on the exact same issue and they are stuck now. USCIS expects you to withdraw the existing AP and apply new one. But in your case since they already denied you have to file new AP if you have travel plans. Now one told you these basics when you came back from India? You did not even check with attorney if they suggest anything in case of emergency travel plans?

You are lucky ani cheppali since your PD is far away and they are not actively working on 485. These are very time sensitive issues and specially when close to end of FY you don't want to be in a situation like this.

485 approve aithe that means u get gc right ? So is there co-relation with i131 ? Bcos those who filed Medicaid they get gc right away than ead card right ?

Your entry exit dates need to be up to date. They cannot approve 485 without this. This means you are not documentarily qualified because while your 485 is pending you went out of country and 131 is supposed to be the form that keep this details current. You have to apply 131 to be eligible for GC. If you plan to leave the country again, then you have to withdraw that and re-apply after you come back.

Even if they approve they can still issue RFE when they process 485. Same thing happened last week for my friend’s brother. They went India while EAD/AP is pending and USCIS approved their EAD/AP and they did not let USCIS know they exit the country. When they picked up 485 for processing they issued RFE.

Did you check the policy. Maa attorney kuda chepadu no issues and new AP is not required. AP approval chesemundu they check the travel history bro @perugu_vadacheck your  i94
