485 (GC), Ead , AP, Spillover issues

I have a confusion about my situation. If someone has a insight that would be a great help.

EB2 PD is Sept 10, 2014 from Employer A. Moved to employer B and perm was in processing so missed the boat to file i485. Perm got approved and filed i140 in EB3. By the time the EB3 got approved, dates moved back

Now I have a EB3 140 with PD September 10,2014. My confusion is that, if the EB2 filling dates move forward, is it better to upgrade to EB2? if so, I am thinking what will happen if the dates moved back like last year

Or its better if I can file a separate EB2 i140 application and do it in premium?

I don't think EB3 dates will move aggressively from now on, even if they do you already have an EB3 140. My suggestion is to get a new EB2 140 with the current employer employer and you can use either one(EB3 or EB2) based on need. Do it in premium so you are ready.   

On a second thought, if your Perm with current employer is based on EB3 then you would require a new Perm to get on to EB2.

yeah literally screwed , eb1c 140 PP antey they will be less to none vertical spill over to eb2.. but the implementation i suppose will take time and could be end of 2023 ..

why will there be a need to a new perm? when my perm was filed, i was given an option to file 140 in both Eb2 and Eb3

Sorry, I made an assumption that your perm is filed under Skilled Worker category( requiring no advanced degree) which will only allow you to file I-140 under EB3 category. If your perm is in fact filed under Advanced Degree category (Job requiring an advanced degree like MS) then you wouldn't need a new perm to file an EB2 I-140.

Don't upgrade.. file separate with complete documentation.. Do it quick.
