Don't think it's mandatory to have 485j to start

If you have downgraded to EB3 filing the I140 as “Amended” instead of “New”, check with your attorney to make sure USCIS didn’t invalidate the old EB2 I140. It appears USCIS has screwed up some people who downgraded last year and will not allow to interfile back unless there is a policy change.

@csrcsr uncle .. idi issue em kadu anukunta .. becos some of my colleagues who downgraded to EB3 in Oct-2020 were starting to get interviews scheduled when their EB2 date became current .. which tells us that .. i140 of both EB2 and EB3 are valid .. ani kada ?

@csrcsr and @Sizzler : If you have FOIA copy of EB3 I-140, check in Page 2, Part 2. Petition Type —> 2.a To amend a previously filed petition.

if the above is not checked, then it is a new petition. If that checkbox is checked, and it has EB2 receipt number, then - EB2 I-140 is amended.
