If your FAD is not current , you can travel bro, you are right. Worst case they will deny your AP. You can apply for it later. Many got AP/EAD while they were in India. Quote

Apply I40 (try even premium) and then file 485 after I40 is approved. Try everything you can to avoid ending up in Texas / Nebraska. Quote
