sam5484u Posted August 16 Report Posted August 16 Hello all, I am looking for some clarification regarding the following scenario I have EB-2 I-140 with Company A. Company B acquired Company A. Just changed the name under successor of Interest. In 2020, we filed 485 with Downgrade by filing EB-3 I-140 on Company A name. And in 2022, when dates were current in EB-2, The attorneys told since now name is completely changed, took over by Company B. the EB-2 I 140 needs to be amended before they interfile. So they did an EB-2 amendment to Company B name and then interfiled. By the time they interfiled, dates moved back. Now, My attorney is saying since we filed 485J and interfile request, now your petition will be in EB-2 only. And If you want to switch to EB-3, they are saying we have file an new I-140. But I already have an EB-3 I-140 with Company A name. so Incase, if my PD becomes current in EB-3. What are my options. 1. Can I ask my company to file 485J with another Interfile request? 2. Or is it better to change company and ask them to file 485J under AC21 with another interfile request? 3. Or as attorney said amend I -140 to company B and Interfile. I asked my company to amend EB-3 I-140 and they are not ready to do saying you're already have 485 in EB-2 Quote
