This generally means that your priority date must be current, background check cleared and medical exams submitted. If your case is not adjudicated before the end of this fiscal year, it is possible that case processing will continue into the next fiscal year beginning October 1, 2021, and the agency may be able to allocate an immigrant visa number from this fiscal year's allotment even if your AOS is approved in the new fiscal year. This is a discretionary measure by the agency. However, the State Department has also indicated that EB-3 immigrant visa numbers may temporarily retrogress in November 2021 as a residual from the October/November 2020 AOS filing surge. Your case will pend during any period of retrogression that may be applicable. While we anticipate that the retrogression may be short-lived, we will not know until the November Visa Bulletin has been released, and will be able to provide further guidance on continued AOS processing at that time.
