Immigration Question

I have one immigration question, please let me know if you guys have any idea

I applied my H1b extension along with my wife H4 extension in April 2020, i got approved in june and my wife's bio-metric was still pending. Her H4 was valid till Aug 2020. Meanwhile she changed her status from H4 to H1 effective Oct 2020. But we received biometric notification now for H4 tat was applied in April 2020.

I checked with USCIS they say that i need to withdraw H4 petition, but my question is if i withdraw her I-94 was valid till Aug 31 and her new I-94 started valid from Oct 1.. Will that not be like a out of status for Sep 2020?

h4 withdraw chesuko...check I-94 number on I-797 approved document (H1B) ... when ever any immigration officer asks for document u need to show I-797... not the H4 one....

ya bro with draw cheskunta but aa 1 month out of status avutey emi problem kadu aa as H1 starts from OCT 2020

She will not be out of status... as she has Pending H4 application at that point of time (Sept 2020) ....

You should not withdraw. Then you will out of status. Update h1b to premium and withdraw after the result.
