I was asked to provide evidence that I did not engage in unauthorized employment and I have my paystub as evidence that I started the work from the date of usceeis approval. My employer is cooperative enough and he stated on his company letter head the same thing. Based off of offer letter, I was issued rfe that I engaged in unauthorized employment. My attorney and I will be submitting the response next week with this evidence. Now, will usceeis reject or consider the evidence and approve? Quote

ATB Hi. I did not work before the approval and it was a stupid mistake of mine to mention a date earlier than the actual start date. My employer also confirmed the actual date on a letter and we have the paystub to back up the evidence. Quote

As far as I know they don’t have any evidence to prove me wrong only the fact that approval notice has a date that doesn’t match the date of first day of work (Offer letter/verification letter) But it is now cleared from employer as usceesis asked for employer’s confirmation as well and we have paystub. So bit tensed. That is absolutely fine. Once you have offer letter, the company applies for H-1B. Date on offer letter has nothing to do with H-1B approval date. If your employment verification letter has a date prior to H-1B approval, then that could be a problem (assuming this would be your Initial H-1B) and you moved to H-1B from a different visa that doesn't let you work. Yeah bro the problem is verification letter has the date prior to the approval but that was based off of offer letter, and that is why I received the rfe. But they asked me to confirm the start date with employer and my employer stated on a letter that although we intended to start him on a date, he started only after the approval. Paystub speaks that. My first pay check period has a date after the approval that means I started working after the approval although my offer/verification letters say 7 days prior to the apporval. Quote

My paystub has a pay period date (first paycheck) a day after approval, which means by common sense I did not work before approval date . My employer stated that I did not work for the company before approval as well. We are submitting these as evidence to prove I did not engage in unauthorized work. Tensed. Quote
