J&K statehood repeal tarnished India’s image globally: Mamata

Amid the all-party meeting being chaired by Prime Minister Narendra Modi on Jammu and Kashmir in New Delhi, West Bengal Chief Minister Mamata Banerjee on Thursday said that the BJP government’s decision to scrap the statehood of Jammu and Kashmir two years ago tarnished India’s image globally.

When asked to comment on the all-party meet, Banerjee said: “I have no knowledge about this meeting. I don’t even know the agenda of the meeting… I don’t know what was the reason for removing the statehood (of Jammu and Kashmir) in the first place. What was the need? This has not helped the country at all. For the last two years, tourists could not travel to Kashmir. It became a question of the country’s prestige. The autocracy there has brought enough disgrace to the country, similar to what the (Covid) vaccines have done.”

The Centre had stripped Jammu and Kashmir of its special status under Article 370 of the Constitution on August 5, 2019, and bifurcated the state into two Union Territories – Jammu and Kashmir, and Ladakh.

In the government’s first outreach to Jammu and Kashmir’s political leadership since then, Prime Minister Narendra Modi on Thursday held a meeting with 14 leaders, including four former chief ministers, to chalk out the future course of action in the union territory.

Meanwhile, Banerjee also lashed at the Centre over the three new farm laws against which the farmers have been protesting on the Delhi border for more than six months. “Anyone who questions the BJP is anti-national… The farmers’ demand for the revocation of the three farm laws is absolutely correct,” she said.

Article 370 is special status known as autonomous given to Jammu and Kashmir state. Features of article 370 are as shown below:

1. Autonomous state
   1. Jammu and Kashmir is a autonomous state. Jammu and Kashmir need not amend all laws passed by parliament unlike other states. Jammu and Kashmir has got its own constitutional body that decides whether to pass/reject law passed by parliament. Example:→ Right to Information Act(RTI) was amended by Parliament but rejected by Jammu and Kashmir government.
   2. Indian government cannot interfere in affairs of Jammu and Kashmir except for defence, International issues and communication.
   3. Verdicts/Orders of Supreme Court are invalid in Jammu and Kashmir.
2. Power of title-“Permanent Residents”
   1. Residents of the Jammu and Kashmir are entitled with special tag “Permanent Residents”.
   2. Non-Outsiders cannot own land in Jammu and Kashmir. Permanent Residents got exclusive power to own land in Jammu and Kashmir.
   3. Only Permanent residents gets admission in schools and colleges in the state. Non-outsiders are disallowed.
   4. Non-Outsiders cannot start business in Jammu and Kashmir. Permanent Residents got exclusive power to operate business in Jammu and Kashmir.
   5. Non-Outsiders cannot build private hospitals in Jammu and Kashmir. Permanent Residents got exclusive power to build private hospitals.
3. Flag and dual citizenship
   1. Kashmir has got special power to have its own flag.
   2. Kashmir residents has dual citizenship. First they are citizens of India and then that of Jammu and Kashmir.

Pro’s:

1. State got special power
2. There is less competition in state medical and engineering exams because non-outsider are not allowed to take up state exams
3. Locals businessman earns more profit because non-outsiders are dis-allowed practising business in state
4. Pollution is very less due to absence of industries sector

Con’s:

1. Discrimination with other states
2. Less competition in state exams suppress growth of students
3. Low Income of the state due to absence of industrial sector
4. Lack of medical facilities due to absence of private hospitals
5. Terrorism due to Pakistan’s claim over Kashmir
6. Lack of basic modern facilities including 24hrs wifi, 24hrs water supply, 24hrs electricity etc
7. More unemployment due to absence of industrial sector

Pakistanis settled in JnK with JnK citizenship then got Indian citizenship and moved into India due to Article 370
