if old employer is willing to file - they can. 

Current employer cannot file unless there is an approved 140 application with current employer. 

Travel : At the time your 765/131 are being processed - if the officer checks your travel status and identifies you are outside the country, our 131 will be denied and only 765 will be issued. You have to re-apply for 131.
