GC EB2 Current March 2014

Hi Guys,

My PD is EB2 March 2014 , but in Oct 2020 filed for Downgrade EB3.

Got AP/EAD ,but EB3 I140 is not approved.

With the current Visa Bulletin since my EB2 Date is current what are the options EB3-EB2 Interfiling or New EB2 485 Filing (i.e Refiling).

My Employer /Attorney said that we have to   File New EB2 485 (i.e Refiling) since my EB3 I140 is not approved .

Once the EB2 485 Notice is received then to withdraw the EB3 petition.

They said they have done this to 5-6 employees in past few months but as of today none got their GC's . 

So I'm not sure what is the right way now.

Is the attorney right or is he giving some advice to make money .

Refile using eb2.

Go for Reflining, u will get it soon, than interfiling.

You have to apply transfer of underlysis basis.
