Waqf board should  not have properties that were donated before 1947 ,  only a few historical places can be exempted. 

That would solve a lot of the issues

But that doesn't stop waqf board from claiming random properties with fake papers 

Cases take decades to finish in courts , Waqf should be only able to dispute properties if they have bullet proof evidence that it belongs to them 

But right now WAQF can claim any property in India and entangle in legal dispute

That still won't solve the problem of them claiming rights to properties that were allegedly given by Muslim kings

That’s exactly what this judgment is addressing… even if you look at the time… it was appealed in 2021 and resolved in 2022.

Also, this judgment will be referred in future cases.

They can just create dated papers that so and so nizam or person donated these lands to us before 1940 

The current law is that if any dispute arises on waqf land , it will be blocked from sale until the dispute is settled. Courts take 20-30 years to resolve disputes

harass mathrame cheyochu… kaani take over never happens… I haven’t seen an instance where farmers or normal people had to forefeit their lands just like that. Have you?

simple rule, a case against state Govt. that allowed prior registrations and collected tax… also come into picture… So, even if the plaintiff can’t directly fight against waqf for their false claims, they can force the govt to handle it by suing the govt.

True they can't takeover but you can't sell your land without their permission  

Hundreds of such cases are pending for decades without resolution. 

If you have a lot of property , you can hold off selling for a long time but poorer people will be screwed if they can't sell  their properties for a long time
