Does NRI need to file ITR in India if he buys an apartment?

Does NRI need to file ITR in India if he buys an apartment in India? He recently bought an under construction apartment in Hyderabad. The builder paid 1% TDS on his behalf. Now does he need to file ITR for this ? He don't have any other income in India.  Few days back he received an email from Income tax department regarding e-Campaign - Non-filing of Income Tax Return for AY 2022-23. Can he select Not liable to file return of Income in AIS portal ? Please help.

As far as I know, he doesn't have file ITR if he doesn't have any taxable income in India.

TDS is paid against builder's PAN. Builder will claim it in his tax returns.

@vithanda_vadhi @ABpropertyconsultenc Thanks for the cofirmation. Few days back he received an email from Income tax department regarding e-Campaign - Non-filing of Income Tax Return for AY 2022-23. It just asked him to confirm the property purchase transaction and TDS amount and confirm whether he filed ITR or not in AIS portal. Can he select Not liable to file return of Income in AIS portal ?

Not liable emundi.. Mee okkarike kaduga chala mandiki sale chestaruga...

It's builder responsibility..

@ABpropertyconsultenc My question is since he received the email from Income tax department what should he select in AIS portal ?

Yes. He can use not liable to file IT. If he has transferred money through NRO/NRE accounts he will have clear paper trial.

If TDS is paid using your PAN. Then you need to file ITR. 
You need to report source of income for buying the property.

@jathin Bro, 1% TDS is paid by builder against his PAN. He can claim that in his ITR. Where should we report source of income for buying property in ITR. I don't see any option? This doesn't say we need to file ITR when we buy property as NRI in India.
