kck2803 Posted October 19, 2010 Report Posted October 19, 2010 Hi,My opt start date is oct 2010 when I check online for the status of my opt it says that "On September 16, 2010, we mailed you a notice that we have approved this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any instructions on the notice"but I have not received any mail. when I called before they said I should wait for 30 days before submitting any request. after 30 days I have called them and placed a service request they said they will be contact me in 30 days.when I asked them that can I work in the mean time they said I cannot the thing is I am already working, so should I ask my employer to run the paychecks or notand one more thing if this process takes one more month and I dont run paychecks for 2 months will it effect when I apply for opt extention ...If I run pay checks will they ask at my opt extension that with out getting OPT card how did you joined the company (But my opt is already approved)so will they have a record that till this time I have not received my opt card)evarina same problem face cchesaraaaaaaa.......Help me
mba Posted October 19, 2010 Report Posted October 19, 2010 mee employer ki cheppi pay check run cheyodhu ani cheppu mama.. vadiki situation cheppu ila illegal nenu work cheyakudadhu.. so pay check run cheyaku eppati nunchi start cheyalo cheptha ani chepu.. wait till you receive your opt card in hand.(OPT approval saripodhu.. chethilo card vundali)OPT approve ayinanatha mathrana nuvu itchina start date a vundadhu.. they wil change to according to when they accepted it.Ex:- 9th august na start date pettavanuko neeku OPT approval konchem late aithe kanuka they will change the OPT start date.say 18th august. neeku OPT card chethiki raavataniki 30th august varaku time paduthundhi.. OPT card lekunda job chesthe(pay checks run chesthe) problem avochu.. try to contact your international center they may help you find the status of your application. sHa_high5ing

pikki Posted October 19, 2010 Report Posted October 19, 2010 First when you apply for your opt and when you money is deducted they will send you " I-797 C, Notice of Action" form means that your application is in process. When they approve your application depending on your address they might send you an approved mail ( address here might be your present address or may be your college address like university center which ever you opted your opt card to be mailed ). They will take certain amount of time to process your request and mails you a link to follow up on your status like in process , approved etc etc .. and ones approved they will mail your opt card for the address you opted for. Since its your first time opt dont worry too much about it, you will get it. You cannot work until you employment date falls in your opt period, its illegal. Your employer cannot run your pay checks until you have your opt card as its legal symbol for you working status here in USA. Ask your employer ( if he is a consultancy guy) to give a personal check so that you it wont be like a pay roll check and you will get money so no worries about that. Generally the process wont take that long but since its first time USCIS will be flooded with a lot of applications thats why they might take time, but ones approved your opt will start on the date you mentioned on you I-765 OPT form.In your first term of OPT you dont have to be a paid employee ( like you can work volunteerly with out pay like a unpaid internship or a reserach assistantship or something like that which is related to your field or which falls under stem category ), but its better to have 20 hours of paid work but not compulsory on that . And at the time of opt extension you need to have your employed letter and the compay should be e-verified which I hope your are working for them now and thats all you can apply for your OPT extension. But ones your OPT extension starts you must be employed and you should be working for 20 hours a week or full time 40 hours. Coming to your last question they wont ask your pay check as such so like i told you ask your employer to give you a personal check and onces you have your card you can run the pay checks and for opt extension you dont have to be a paid employee so dont worry about the pay checks.
