How are you claiming he is aggressive?

 

Several witnesses observed Neely making threats, assistant district attorney Joshua Steinglass told the judge. Some witnesses told police that Neely was yelling and harassing passengers on the train, authorities said. Police sources told ABC News that Penny was not specifically being threatened by Neely when he intervened and that Neely had not become violent and had not been threatening anyone in particular.

judiciary is part/branch of the government.. not a private entity

Counter-argument: Neely was not threatening anyone in particular doesn't mean he is not threatening. They clearly told he is yelling and harassing. A raging bull doesn't threaten anyone in particular. There's no video evidence of what happened and there are two other people restraining Neely at the end of the video. Choke hold could be accidental

Being a junkie is a crime but the source of drugs is not investigated as part of the case!

Since when did yelling become a crime? It is disorderly conduct at the max. Harassing? It needs to be proven. I want to get into the details than just making a claim. We live in a world of Karens who claim everything is harassment if not done their way, while the willful lying and lack to serve and respect are not taken as harassment. Women are bunch of control freaks. They even claim first amendment auditors are harassing! These same people walk away when we get threatened with "Go back to your country, brown trash. We will blow your ass." These people don't call this harassment. They use "very unfortunate" but it is freedom of speech.

Even I lack evidence but my gut feels that his conduct was unruly at the worst. He doesn't deserve to die.

He has the freedom of speech. If he touched anyone, it should have been an assault case. No one claimed he touched anyone!
