Mistake is taking money in initial months without lease agreement. What judge ruled is right - landlord did a mistake here

what is the verbal lease? You can interpret anyway you want. Tenants can say " we pay for few months X dollars and then won't pay for next 10 years" . 

I think story is nothing to do with CA - probably some other judge may say : " you need to have lease, if not, it is considered trespassing". 

In USA, never take money without a paper trail. If not, police can as well say it is drug money. Go and read if you have any doubts. People lost life time savings when they are trying to take cash across state lines to buy property , RV, car etc.
