Simultaneous I-140 transfer and I-485

I have I140 from company A.  Say my priority date is current but I am at company B without I140 transferred. Can I initiate I485 and I140 transfer at the same time? Thanks in advance

There is no 140 trasnfer as such , anna when you work with company B , (only porting of pd ) you have to go through PERM process which takes about 18 months 

then you can apply concurrently 140 and 485

On thing is once 140 is approved with company A and you worked for 6 months you can get n number of h1 extensions

Is your pd current ? 

 

The best case would be company A can file 485 even you are not working with them

Thanks bhayya for the reply. In regards to the best case like you said, not sure how Company A could file my 485 even when I am not working with them? as its not a desi consultancy, It was a full time gora hospital job

In your case best case might not work , the trick is if you go back they can easily apply i485, in your case there are 2 options.

Go back to emp A and assuming your i140 is not revoked they can apply i485.

Go through the perm i140 i485 route from company B.

They did not revoke it for sure as I was there for more than 8 months after approval. If filing dates become current as mandar said in Oct, 2023 it may not be even possible to get my H1B transferred from my current employer to previous employer to make use of my I140 PD 😞

What's your PD ? 2013 or above aytey keep your expectations low.

Perm cheyali ani cheppa kada anna if you are missing tge pd like dates went back at least your 485 will be filed adi chepanu
