I got two LCA's from my immigration team - one for each location/state. Here is the Chat GPT answer. Do you get two LCA's or One LCA when working from home and work location is different When an employee works from home and their work location (office) is different, the situation may involve two different LCAs (Labor Condition Applications) if certain conditions are met. The LCA is a necessary step in the process of obtaining an H-1B visa for skilled foreign workers in the United States. The LCA is filed by the employer and is intended to ensure that hiring a foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers. Here's how the situation with two LCAs can arise: Home Office LCA: If the employee primarily works from their home and their home address becomes their primary worksite, the employer may be required to file a separate LCA for the home location. The LCA must reflect the wage levels and working conditions prevailing at the employee's home location. Worksite LCA: If the employee is required to travel or work from the employer's office for any significant amount of time during their employment, the employer may also be required to file a separate LCA for the office location. However, if the home office is simply a convenience for the employee, and the employee is not required to work there regularly, the home location may not need a separate LCA. It's important to note that the LCA filing process and requirements can be complex, and the specifics may vary based on various factors, including the immigration status of the employee and the nature of the work arrangement. Employers should consult with immigration attorneys or relevant authorities to ensure compliance with the applicable laws and regulations. Quote
