CBI Court did not accept the charges levied by CBI on YS Jagan and Vijaya Sai Reddy under IPC section 409 and Section 12 of PC Act. But it is of no relief for them.

Section 409 of The Indian Penal Code deals with the Criminal breach of trust by public servant, or by banker, merchant or agent. Section 12 of The Prevention Of Corruption Act deals with the punishment for abetment of offences defined in section 7 that a public servant taking gratification other than legal remuneration in respect of an official act.
