Was it approved when final action date was NOT current ? What was the approval date and what is your PD ? Lest check the bulletin chart if the approval date had final action date you can contest else follow what attorney says anna sad to hear

I think it’s better you move to H1. Since you never know how long court proceedings will take? Also you may not get your GC until it’s current again in future. 
 

but it’s worth going to court. You have nothing to lose. Other than some $$$

Ombudsman edo untadi , ilantivi cheste vallu support chestharu, create a case with them, send all documents when you create a case.

Not a legal advice:

Apply for FOIA and get your A-file copy. That way you can confirm if a visa number was alloted to you before dates retrogessed. If visa number is alloted after dates retrogessed then you don't have much options and follow attorney advice.
