స్కిల్ డెవలప్‌మెంట్ స్కాంలో టీడీపీ అధినేత చంద్రబాబు దాఖలు చేసిన బెయిల్ పిటిషన్, సీఐడీ దాఖలు చేసిన కస్టడీ పిటిషన్లపై విచారణను ఏసీబీ కోర్టు రేపటికి (గురువారం) వాయిదా వేసింది. రేపు ఉదయం 11 గంటలకు తిరిగి ఈ పిటిషన్లను విచారించనుంది. తొలుత చంద్రబాబు తరఫున సుప్రీంకోర్టు న్యాయవాది ప్రమోద్ కుమార్ దుబే వాదనలు వినిపించారు. మధ్యాహ్నం తర్వాత సీఐడీ తరఫు న్యాయవాది పొన్నవోలు సుధాకర్ రెడ్డి వాదనలు వినిపించారు.

ఈ కేసు దర్యాఫ్తు కీలక దశలో ఉందని, చంద్రబాబు బెయిల్ పిటిషన్‌ను డిస్మిస్ చేయాలని పొన్నవోలు కోర్టును కోరారు. ఆయనకు బెయిల్ ఇస్తే సాక్షులను ప్రభావితం చేస్తారన్నారు. ఈ కేసుకు సంబంధించి రూ.371 కోట్ల దుర్వినియోగం జరిగిందన్నారు. డొల్ల కంపెనీలతో దోచుకున్నారన్నారు. 2017లోనే పన్నుల ఎగవేతపై జీఎస్టీ హెచ్చరించిందని, సీబీఐ విచారణ చేయాలని జీఎస్టీ కోరిందని తెలిపారు.

కేసు కేంద్ర దర్యాఫ్తు సంస్థల విచారణలో ఉన్న సమయంలోనే 2018లో 17ఏ సవరణ జరిగిందని, ఈ క్రమంలో 17ఏ చంద్రబాబుకు వర్తించదన్నారు. ఈ కేసుకు సంబంధించి ఆధారాలను కోర్టు ముందు ఉంచామని, పూర్తి ఆధారాలతోనే అరెస్ట్ జరిగిందన్నారు. సీమెన్స్‌తో చేసుకున్న ఒప్పందాన్ని జీవో నెంబర్4లో ఎందుకు చూపించలేదని అడిగారు. కేబినెట్ ఆమోదంతో ఎంవోయూ జరిగిందనడం అవాస్తవమన్నారు. ఇరువైపుల వాదనలు విన్న ఏసీబీ న్యాయస్థానం విచారణను రేపటికి వాయిదా వేసింది.

స్కిల్ డెవలప్ మెంట్ కేసులో టీడీపీ యువనేత నారా లోకేశ్ కు ఏపీ హైకోర్టు స్వల్ప ఊరటను ఇచ్చింది. ఈ కేసులో లోకేశ్ ముందస్తు బెయిల్ ను ఈ నెల 12 వరకు కోర్టు పొడిగించింది. లోకేశ్ కు హైకోర్టు ఇచ్చిన ముందస్తు బెయిల్ ఈరోజుతో ముగుస్తోంది. అప్పటి వరకు వరకు లోకేశ్ ను అరెస్ట్ చేయవద్దని సీఐడీకి ఆదేశాలు జారీ చేసింది. సీఐడీ తరపున అడ్వకేట్ జనరల్ శ్రీరామ్ సుబ్రహ్మణ్యం వాదనలు వినిపించారు. తమకు ప్రభుత్వం నుంచి ఎలాంటి ఇన్స్ట్రక్షన్స్ లేవని.. అందువల్ల వచ్చే బుధవారానికి విచారణను వాయిదా వేయాలని కోర్టును ఆయన కోరారు. దీంతో, విచారణను హైకోర్టు వాయిదా వేసింది. అప్పటి వరకు లోకేశ్ కు భద్రతను కల్పించాలని ఆదేశించింది.

ఇదిలా ఉండగా, వైఎస్ వివేకానందరెడ్డి హత్య కేసులో అవినాశ్ రెడ్డి తండ్రి వైఎస్ భాస్కరరెడ్డి ఎస్కార్ట్ బెయిల్‌ను సీబీఐ కోర్టు అక్టోబర్ 10వ తేదీ వరకు పొడిగించింది. భాస్కరరెడ్డి బెయిల్ నిన్నటితో ముగిసింది. అయితే ఆరోగ్యం కుదుటపడకపోవడంతో మరికొంత సమయం కావాలని కోరడంతో న్యాయస్థానం ఎస్కార్ట్ బెయిల్‌ను మరో వారం పొడిగించింది.

Afaik, quash is about how they arrested him and sections used. Quash approve aithey cbn meedha ee case kottestharu. Malli fresh gaa same case lo investigation cheyyochu anukunta. Correct me if i am wrong

Section 482 C.R.P.C has a very wide scope and is an essential part of the statute to meet the end of justice where injustice can take place but at the same time the said Power is too wide and hence, it is important for the courts to use it wisely and according to the guidelines laid down by High Courts and Supreme Court time to time.

 Section 482, in its current form, has seen several changes with the changing times and needs of the hour and by the Guidelines framed by the Supreme Court in several of its judgments. The Courts are constrained to do so as the said Section which gives wide powers to the High Court, was highly abused by the Law Practitioners.

Section 482 of C.R.P.C has made its space in C.R.P.C in order to enable the High Courts to provide proper justice and at the same time to curb the filing of fictitious complaints just to avenge personal grudges.

This section gives the power to the high court to entertain application which is not contemplated by this code

This section helps the appellant to get FIR quashed, based on false implication, Or if there is no evidence in support of the facts mentioned in the FIR

If it is apparent on the FIR that the accused is innocent and the complaint is made in collusion with police and complainant.

In exercise its jurisdiction under this section, the high court can not embark upon an inquiry as to whether the evidence in the case is reliable or not. But the high court under this section goes into the question as to whether there is any legal evidence to issue any process against an accused person In an application to quash the criminal complaint the court needs to consider whether the complaint and sworn statements disclose any offense. Whether the allegations are true or not does not come under scrutiny at this stage.
