I think H4-EAD should stay but H1 should be made stricter. Increase salary requirements, make it difficult for consultancies to exist. H1Bs should be restricted to top companies with high salaries. This is my 2 cents to increase talent in Omerica.

How many H1Bs are qualified? Sorry to say but majority are not. Many are just foot soldiers . We are not living in Utopia and life is not meant to be fair. Might is right and connections matter. You are looking with bias and you are finding such examples. Many H4EADS are much better and more qualified than H1Bs. There are many H1Bs who are good for nothing. They should be kicked out first.
