Safeway employee fired for trying to stop alleged shoplifter... it happens onlyin Bay Area

A former Safeway employee, Antoinette Baez, says she lost her job in San Mateo for trying to do the right thing.

Surveillance video from February 2023 shows Baez and another worker confronting a suspected shoplifter. The person’s arms were filled with $500 worth of groceries that Baez claims they did not pay for. The confrontation cost Baez and the other employee their jobs.

“They would rather let people just steal from the store than have an employee in anyway interfere with the theft so it’s basically an open house for thieves,” said Baez’s attorney, Neil Eisenberg.

Safeway fired Baez in May 2023. Over the next several months, Baez was unable to collect unemployment benefits because Safeway said she was terminated for misconduct.

Eisenberg said Safeway has been cracking down on employees instead of thieves.

“She’s a single mother. She’s had no income and no health benefits for the last year, and she hasn’t been able to be employed because her only job experience is being a cashier at Safeway,” Eisenberg said.

Baez and Eisenberg took her fight to the Employment Development Department (EDD). This month, a judge ruled she was let go for performing her duties. The ruling means she will now get unemployment benefits from the time she was terminated.

Eisenberg says after 22 years of working at Safeway, Baez deserves better. “She was an exemplary employee and they simply kicked her to the curb,” Eizenberg said.

Eisenberg said he’s planning to file a lawsuit against Safeway seeking punitive damages of up to $1 million dollars for his client. He says it’s not about the money, but the message that Safeway employees should be treated better.

We’ve reached out to Safeway for comment and as of this report, they have not responded.

not it doesnt happen on in CA.

it happens everywhere in US. Its company policy in almost every retail stores not to engage when shoplifting is happening. Worked on a project specifically to create a dashboard for shrink (loss due to theft). Management says it costs less to let it go than to prevent it.

What is going to happen if the employee gets hurt while preventing theft ? They are going to sue the company later duh. 

Only exception is for shrink officer or security person whose job is specifically to prevent shoplifting.

employees steal too.... it happens more often. If its still within the acceptable margin then they would let it go. Dorikithey either fire or case ( if possible)

Yeah but idi telisinde gaa evadapamannadu let the thieves steal. San Francisco exists for that reason alone, Bay area isn't far behind.

So once it starts costing more then armed response is ok?

If that is the reason you are giving then individual/small shop owners aiyte shoplifters ni pagal d*ngali because for them even small items are a big deal and if CVS/Walgreens leave a certain area because shrinkage is high then ppl in that area shld not cry.

Actually we can better this idea by saying

- Store employees gets bonus if they make sure thief gets help to steal the right items without randomly looting the Isles. This way he ensure the next set of deserving thieves are not deprived of the items they really need.

This improves efficiency in stealing and makes thieves life better. Emantav?

if law allows armed response then people/companies will follow law. Just like how people exercise "Stand your ground" or "Castle doctrine" laws . May be in future someone will propose it in congress.

And people will cry regardless . 

If its costing more then companies will put extra steps whcih will be extra burden to paying customer.

ade bhayya, big companies like safeway/target can have analytics/dashboard to do cost analysis due to theft but chinna chinna individual stores paristhiti enti. They can claim insurance but next time insurance prices will increase kada. 

Why not be extremely harsh on theft? Cost perige varuku big stores waiting is encouraging it. Also, videos lo its not like they are stealing bread because they are hungry. Some ppl steal iphones and luxury goods, valaki aiyte punishment inka severe ga undali.
