Tollywood hero Junior NTR, who is embroiled in a 21-year-old land dispute in Jubilee Hills area, has approached Telangana high court, seeking relief after the Debt Recovery Tribunal (DRT), Hyderabad, gave primacy to banks in what the actor alleged were trying to take over his property despite being in possession of genuine documents.

The property (a 681 square yard plot) on Road No.

75, Jubilee Hills, which the actor bought for Rs 36 lakh back in 2003 from Sunku Geetha Lakshmi in Jubilee Hills Housing Society, is now valued close to Rs 24 crore (present market rate is Rs 3.5 lakh per square yard). Jr NTR also built a luxurious house on the plot.

On Thursday, a vacation bench of Justice Sujoy Paul and Justice J Sreenivas Rao wondered why did the actor approach the HC against an order of the DRT when he had an appellate remedy in the form of Debt Recovery Appellate Tribunal (DRAT).

When the actor's lawyer pointed to a technical error in the DRT order, the bench directed him to furnish the docket order by June 3 and posted the case to June 6.

Jr NTR said: "The title documents pledged with the banks and the title documents I have with me were sent to the forensic laboratory and my documents were confirmed to be genuine. All the bankers are now facing criminal charges."

'Previous owner's kin created fake docus to obtain loans on property'

The DRT, however, said the claims of the banks have primacy since they have a lien over the property from 1996 itself, whereas NTR acquired rights over the property in 2003.

A legal expert said the legal right to seize or sell a real estate property on non-fulfilment of a contract is referred to as a real estate lien. "In case one borrows a loan from a bank in order to buy a house, a lien is placed on the house by the bank until he/she pays off the mortgage," he said.

Police, in their chargesheet filed before a trial court in 2019 following a complaint, had said that Sunku Vishnu Charan, whose sister-in-law is Sunku Geetha, and his associates created fake documents and obtained loans from banks on Jr NTR's property.

Jr NTR, through his general power of attorney (GPA) K Rajeswara Rao, had earlier argued before the DRT that the police probe conclusively proved that this was a fraud perpetrated on him and that police had filed the chargesheet against his vendor as well as the branch managers of six banks. "The banks are now trying to take over my property to save their skin," the actor alleged.

Since Sunku Geetha mortgaged the land documents and obtained a loan from Chennai-based Upasana Finance Limited, Jr NTR cleared the loan and secured the title documents.

The actor paid huge amounts to Sunku Geetha in 2003 and got the plot registered in his name. But later, he ran into several legal issues from various banks, which were trying to take over the plot and auction it to realise the money they lent to Sunku Geetha in 1996 itself.

It was then the actor filed a complaint with Hyderabad police.

Police, during their probe, had concluded that Sunku Geetha connived with the bank officials and duped the actor because the same property documents were pledged with various banks for obtaining loans.

This fact was suppressed before the plot was sold to Jr NTR, the police said.

The lender banks - SBI, Oriental Bank of Commerce, SIDBI, Bank of Baroda, IndusInd Bank and Federal Bank - had then approached the DRT and secured recovery certificates from it to enable them to attach the property under the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002, and then to auction the same to realise the money.

At that point, Jr NTR had made Rajeswara Rao his GPA to deal with court cases. The current plea before the high court was also filed through the same GPA holder.

Meanwhile, deputy solicitor general Gadi Praveen Kumar has said the actor cannot come to high court directly when he has the appellate remedy against the order of the DRT.

Looks tdp/yellow mafia behind this to trouble Jr. NTR and hit his financials.

They can do nothing. Jr.NtR ni dhebba kottalantey chala kashtam, jr main source of income is movies, producers ni internal ga jr tho movies cheyakunda debba kottalanna jr ki lucky ga fans vunnaru and vallu gola chestharu which puts pressure on producers to grab him to cash on his craze.
if jr is small time actor or the one who doesn't have big fan base, tdp/cbn/lokesh eppudooo jr ni thokki thokki nalipesevallu or jr brathakalantey tdp ki oka banisa ga seva cheyale.
but now jr is a star hero and succeded in career with his hard work, he is ignoring them and showing middle finger and stil tdp cannot do anything. He is rich, has name fame and fan base, eeka kooda peekaleru jr ni vallu.
