Check NVO and LLY previous lawsuits on compounders. 

They were either thrown away or they lost and incurred a fine.

They are also big violaters and paid fines in over a billion dollars.

 

They routinely use lawsuits to scare small compounding pharmacies into shutting down as small pharmacies don't have money to fight.

NVO has Bullcrap management. They are good for nothing. They lost their patent in Canada cuz they forgot to pay minor patent maintenance fee (200-400$) even after reminding them.

I am not saying this will be thrown out. But we have to dig deeper.

Semiglutide revenue was mostly during shortage. Compounding pharmacies would still have 90 days after shortage ends which was Feb 2025.  They should have stopped in MAy and they did.

And HIMS shifted away to concentrate on other weight loss drugs which had no patent. There was a drop in revenue too which shows that HIMS complied with the rules. "The GLP-1 business generated $190 million in online revenue during the second quarter of 2025, a decrease from the $230 million recorded in the first quarter of 2025." And after the period ended, semiglutide was offered only through personalization which is legal. They pushed personalization clause to its limit. This is what NVO is going after.

 

Also When HIMS, NVO and LLY received a warning letter from FDA to add disclaimers last year , HIMS was the first company to take swift action. NVO and LLY took time. They have been complying and this should be noticed favourably by the court. Point to note is that NVO and LLY also got wanrning letters but the headlines were after HIMS during that time.

 

Headlines are always against a disruptor because everyone is stuck in old times. 

HIMS is not just a GLP 1 company. And recently they added testosterone, menopause, early cancer detection and full body tests. This earnings should be exciting from that front. It will take marketshare from Quest and CVS as well. And telehealth is included....no need to jump through loops. They can also combine medications into one pill.

Its a complete ecosystem. They also recruited Dheerja who designed the UI for Robinhood. They have also spread to Canada and Europe.

People forget that.

In my opinion, worst case scenario, there might be a fine and some loss of revenue. It shouldn't warrant a 70% drop. Don't think DOJ would bankrupt a multi billion dollar US company selling affordable drugs on a complaint from a Danish company. HIMs also donated to Trump campaign if that matters.
