What’s stopping them from following off record even now? Police will take action only if someone reports?

Good question and the answer is conplicated.

For ex: when there is a legal issue and when they started to solve it via Sharia Law and if that problem is not solved, both the parties go to American Law.

Since Sharia is not officially banned, American court will take into consideration all the previous attempts to solve the problem. In short they will continue from the point where it was stopped.

But now, parties cannot simply show that they tried to solve the problem in the first place via Sharia

This looks just okay in the first instance but the court charges new cases on both parties for they followed a Law thats banned.

Things really get tougher for both parties, especially cases related to marriage, divorce, properties and immigration.
