This proclamation’s restrictions apply only to H-1B workers who are outside the United States and seeking entry as new nonimmigrants under the H-1B specialty occupation category after the effective date (September 21, 2025). It does not apply to individuals who already hold valid H-1B status inside the U.S.

Specifically:

  • Section 1(b) restricts petition approvals for workers currently outside the U.S.

  • Section 3(a) states the restriction applies only to aliens who enter or attempt to enter the U.S. after the effective date.

  • No restriction or fee requirement is imposed on extensions, transfers, or change of status of existing H-1B workers already in the country.

Thus, employees currently working under valid H-1B status in the U.S. are not subject to the new $100,000 payment requirement or entry prohibition under this proclamation. It targets only new foreign workers seeking initial admission on H-1B visas outside the U.S.

you will be stopped at poe unless there is a payment of 100k made or you work for some non-profit org or they think you benefit and more valuable to this country.

ya naku ide artham aindi, but someone here said they are not gonna extend your I-94 at the time of renewal that will force you to go for consular interview.
