🚨 F-1/H-4 ➜ H-1B (Change of Status) & the $100K fee — Do you pay $100K for new cases?

 

Current Status as of Sept 28, 2025 Short answer:

❌ No, if you’re inside the U.S. filing an H-1B Change of Status (COS). For next year’s CAP filings, unless something changes in future, this fee should not applicable for COS based filings where beneficiary is in USA.

Why:

🔹 The presidential proclamation ties the $100,000 fee to new H-1B petitions for beneficiaries OUTSIDE  the U.S.

🔹 Agency memos can’t expand the proclamation—the text of President’s executive action controls.

🔹 So COS from F-1 or H-4 (filed while you’re in the U.S.) = NO $100K fee.

Watch-outs: ⚠️ B-1/B-2 COS will face extra scrutiny under the proclamation’s intent — Proclamation specifically talks about COS for B-1/B-2 status.

✈️ Travel risk: For new H-1B, If you leave and switch to consular processing, the fee could be implicated if your case is filed after Sept 21, 2025 —talk to counsel before flying for new H-1B filed after September 21, 2025.
