USCIS issues further clarity on the Presidential Proclamation and $100k fee

This fee applies to:

  1. Any petition filed for beneficiaries outside the U.S after September 21st.

  2. Any petition filed requesting consular processing even for beneficiaries within the U.S.

  3. Any extension/amendment/COS petition where the USCIS finds out the beneficiary is not eligible for that request ( for eg.the beneficiary didn't maintain the status, the petition is approved without I-94, the beneficiary departed the U.S. before adjudication)

ok...here is the scenario

  • extension filed in America and eventually got denied
  • and the candidate had to leave America 
  • his employer filed a cap-exempt petition from outside America

the candidate is not NEW to H1 in this case...it is just that he had to leave the country as I-94 has expired or about to expire...what happens now? is it subject to 100K fees?

How to pay the $100,000 payment:

 

Petitioners should submit the required $100,000 payment using pay.gov, following the instructions on pay.gov at the following link: https://www.pay.gov/public/form/start/1772005176.

 

When to pay the $100,000 payment:

 

Payment must be made prior to filing a petition with USCIS, as petitioners must submit proof that the payment has been scheduled from pay.gov or evidence of an exception from the $100,000 payment from the Secretary of Homeland Security at the time of filing the H-1B petition. Petitions subject to the $100,000 payment that are filed without a copy of the proof of the payment from pay.gov or evidence of an exception from the Secretary of Homeland Security will be denied.
