Pending H1b approval

Hi, for context I am Canadian, currently living in Canada. I applied for cap-exempt H1b (family physician contracted to work in rural area) in September. My J1 waiver has already been approved. The H1b paperwork was originally filed 09/17, but there was an error on the paperwork, resulting in a re-filing via premium processing with a date of 09/27. The 15 days of premium processing is passed with no decision. We received a notification for RFE on 10/23. My lawyer is now saying she will email USCIS the proof I should be exempt from this 100k fee for National interest reasons. Anyways, i am looking for any guidance, recommendations. Should I start looking for a job elsewhere (ie, in Canada as a physician). Thanks.

EDIT: My lawyer clarified. The RFE is requesting 100k, or proof I am in he national interest.

Best of luck! If this type of exemption isn't approved, nothing will be. I'm sure your employer could show they haven't been able to find a U.S. worker, which is what the latest exemption guidance is requiring.

 

A bunch of medical associations, including AMA, submitted a letter to DHS in support of a blanket exemption for all physicians. Was hopeful it would work, but USCIS's latest guidance on exemptions seems so strict and doesn't reference the industry wide exemptions that are mentioned in the proclamation. People will literally die because of this BS.

Thank you! & yes, my thoughts exactly. I am coming to the US to provide valuable services, to treat an underserved/rural population (as it is a requirement for J1/H1b docs to practice in these areas for at least 3 years). My position has been unfilled since 2024.. my husbands position (he is PCCM) has been unfilled since 2019. Nearly 30% of practicing physicians in the US are International Medical Graduates!! If they dont want me, I am at least in the lucky & privileged position to go back home and practice in Canada. But yes, many people (mostly the rural/underserved communities) will suffer from this law

 

if it doesn't change, & fast.

I would assume it's because they're a physician and not an entry level analyst, salesforce admin, or product manager.

 

We should be granting physician exemptions whenever possible, so long as Americans cannot be found.

Out of country I guess. Also depends how long they are out of country. If their past data is still present or not.
