Initially, my company had informed me that they would file a new petition, but after I returned to India, USCIS guidelines changed that cap exempt will fall under 100k category I consulted a few immigration attorneys, and they said I would fall under the 100K cap since the petition would be filed from outside the U.S. Additionally, I have already completed three years on H-1B and am currently in my fourth year. My ultimate goal is to return and live in the U.S. Could you please suggest what options I have to go back without paying the 100K? For context: • My I-140 petition has been filed in premium processing and is currently pending. • I own a home in the U.S. — selling it now would result in a loss, and even renting it out would still leave me paying about $1,000 per month from my pocket. I would really appreciate any suggestions or insights on possible pathways to return to the U.S. under these circumstances. Quote

HugoStrange Posted November 3, 2025 Report Posted November 3, 2025 No option but wait till next sept for the proclamation to end (hope they won’t extend it) and then come back with a new H1 other option is come here in F1 for spring and then convert to h1 again ask the attorney to see if you can come on b1 visa to sell your home and then convert back to h1 1 Quote

After you know revocation was not because of your fault, may be negotiate on a 25k less salary per year or no bonus or both with employer so that they can pay the 100k now and then make up for that money in the next 3-4 years no?
