helpneeded Posted September 17, 2011 Report Posted September 17, 2011 HiI applied h1 and I got a query. My situation is such that I can not now send evidence supporting the rfe. And I have another employer who is willing to file new h1. Can I apply for new H1 while the old H1 is still under rfe? Please suggest.thanks Quote

But to give u a little headsup that if your opt is expired and if you applying the new H1B with the new company/ employer in the cap gap remember that you cant work until your rfe is cleard and approved or the new h1b is approved, since the change of status effect starts on oct'1 so rush what you are doing to reply ur rfe or new h1b.
