let me give you a scenerio:

For example: you OPT Expires on feb 10th 2012, and you filed for H1 on Jan 2012 (you did not receive any confirmation) than after Feb 10th you are legal to work until you get your H1. and the gap between feb 10 and H1 approval is called cap gap where in you can work legally.
