[/quote] [b]No[/b], you cannot transfer your approved h1b petition as you will not change your status to h1b visa till oct'1 2012 (assuming you are on opt ext or cap-gap). Before Oct'1 2012 you have to file a new h1b petition and after Oct'1 2012 you can transfer your h1b visa. I faced the same situation once. -- Consult an immigration lawyer on how to go about the visa process. Quote

MusuguVeiMazzaChei Posted July 3, 2012 Report Posted July 3, 2012 If you want this process to happen ur full time Employer should file for New H1(sice quota ayyipoyindhi ganaka) .eppudud all u can do is wait for oct1st and have 1 pay check run with previous employer and then u can intiate a transfer process.but oka sari immigratation layer tho verify chesko... YOU CANNOT START TRANSFER PROCESS NOW Quote
