His new employer, however, does not file an H-1B transfer for him. As a result, tom_bhayya will never be able to change back to H-1B status since he is no longer qualified for the exception rule.

you can use AP for travel and work on H1B if its valid. If you use EAD for work if something happens to your application then you will have to leave with no option

using AP for travel is not at all risky, EAD and AP are completely independent. Yes you are gonna have secondary inspection at the port of entry and some of the countries like UK doesn't accept AP as a valid visa for travel

so even without getting H1B stamped u can reneter on AP and work on H1B?

1. What happens to the H4 visa when the spouse uses an AP?

If the spouse uses AP, then they become a parolee. The H-4 becomes irrelevant. It can, however, be reinstated if you extend your H-1B status, and include your spouse in the renewal as well. But this is not necessary.

 

2. What kind of document should the H4 carry beside the AP?

3. To keep the spouse in status, is it necessary to renew the AP every year?

No - a parolee by definition has *no* immigration status in the US - that's why they are called parolees. The AP only allows somebody to be paroled, but does not confer status while in the US. Once they are in the US, they are considered in "Authorized Stay" because of a pending I-485.

asalu technical ga ela possible bro...AP midha vachetappudu ur not considered to be in any immigrant or non immigrant status...malli H1B ki convert ela avutharo..i mean emanna apply cheyyala uscis ki ila H1B COS kosam ani...

but its very helpfull if thats the case

this is right, you can use AP for entry and still stay on h1b as long as you have a valid h1b document at time of entry, i did the same last year when returned my india, my wife is still on h4 n i have EAD + AP (combo card), i had valid visa too, i presented both visa & combo card along with H1b document, my wife was given port of entry n i was taken to a separate room, there the officer asked you want to use AP or Visa, i asked which one i can use given my wife is on h4, she replied you can use any of status it wont affect her n said use AP coz your visa has only few months left on it. i hope this settles the ambiguity for everyone on this forum
