tom bhayya Posted November 18, 2014 Report Posted November 18, 2014 this is right, you can use AP for entry and still stay on h1b as long as you have a valid h1b document at time of entry, i did the same last year when returned my india, my wife is still on h4 n i have EAD + AP (combo card), i had valid visa too, i presented both visa & combo card along with H1b document, my wife was given port of entry n i was taken to a separate room, there the officer asked you want to use AP or Visa, i asked which one i can use given my wife is on h4, she replied you can use any of status it wont affect her n said use AP coz your visa has only few months left on it. i hope this settles the ambiguity for everyone on this forum GP nenu bhi adhey vinna..

dotnetrockz Posted November 18, 2014 Author Report Posted November 18, 2014 final conclusion: http://www.murthy.com/2008/03/21/effect-of-trav... 1)Your H1B is still valid if it is not expired in I-797, though you dont have stamping and entered on AP. But your status shows as Parolee. Not a problem :-) , still your H1B which is not expired I-797. 2)Though you have entered on AP, you still eligible to extend your H1B if the old H1B not expired and do it before that expiration. When you extend your H1B your status will be H1B. Not a probalem :-), still you can renew your AP/EAD. 3)Lets us say you have entered on AP, no H1B stamping this time. Next time when you go to India, you can still go for stamping. Here it is your wish you want enter based on AP or stamped H1B(if you have went for stamping). I have concluded above statements from the link. Please correct my assumptions if there are any wrong conclusions from above. I do not want misguide any one. :-)
