Travel To India With Existing H1B Visa And Also Future I797

Hi,

 

I need an help for below situation and let me know if you aware if this situation.

 

My current H1B is expiring on March 4th 2015 and recently applied for extension which is currently in regular process. unexpectedly, i will have to travel to India in December. 

 

Is it safe to travel during this period ?

 

Am I eligible for return on POE in December or before March 4th 2015 ? 

 

My lawyers says i can re-enter with old I797 but will have to leave US before March 4th 2015 for VISA stamping .

 

Should i have to expedite new H1B extension and is it good to have approval before leaving US  ?  

 

Let me know if you have valid information.

hi Deal Raja,

 

this is not true, I was in the same scenario couple of months back. you don't have to attend stamping in march 2015 as your lawyer stated.

expediate your h1b processing and get appoeved before leaving and as chicha1 said you dont need to attend for visa again.

Thanks Chicha1...All of my friends were saying I don't need stamping but wanted to ensure as my lawyer was insisting that i should leave country before March 2014.....
