Help On H1 Transfer Urgent

Hi,

 

I am on H1 B, presently working for a consulting company(desi) as contractor. I finished my project recently in Nov. 1st week and on bench since now. I got a Full Time now with another Desi company and willing to transfer my H1.

 

I have last pay stub ran for only 3 days in November(paid on Dec 15)

October pay stub(ran for 30 days, paid on Nov 15)

September pay stub(ran for 30 days, paid on Oct 15) 

 

1) Is it better to apply for H1 transfer or will there be any RFE

2) If my H1 transfer has any RFE, can I still continue with my old employer(as my employer does n't know)
